Leyland’s Travel Australia – Terms and Conditions

By booking a tour with us, you agree to the Terms and Conditions below. These terms form part of your contract with Leyland’s Travel Australia.
We”, “our” and “us” refer to Leyland’s Travel Australia and our employees or representatives.
You” refers to each participating traveller. All travellers must accept these Terms before the tour begins.


1. Acknowledgements

By joining one of our tours, you acknowledge that:

  • Our adventures take place in remote areas, and itineraries may need to change due to conditions or operational requirements.
  • Tours are self-drive and may involve challenging terrain and variable track conditions.
  • Exact arrival and departure times cannot be guaranteed.
  • We are not transport operators, hoteliers, travel agents, or accommodation providers. Bookings may be subject to the terms of third-party suppliers who may limit or exclude their liability.
  • We rely on the information and assurances you provide to us.
  • A minimum of three (3) participating vehicles is required for a tour to proceed (tag-a-long tours).
  • A minimum of six (6) participants are required for a tour to proceed (small group bus tours).
  • Accomodation dependant on availability at time of booking, alternative accommodation may be required.

2. Your Warranties (What You Confirm)

You confirm that:

  • If driving, you have the skills and experience necessary to safely participate in the self-drive elements of the tour.
  • You do not have any medical condition or disability that could affect your participation.
  • You hold, or will hold before departure, comprehensive travel insurance that includes cancellation, medical treatment, evacuation, injury, theft, and related losses.
  • If driving, you hold a current driver licence recognised in Australia for the entire duration of the tour.
  • Your vehicle is registered, comprehensively insured, roadworthy, and suitable for the terrain.
  • Your vehicle has been properly serviced and maintained prior to departure.
  • You have read and understood these Terms & Conditions.
  • You will supply proof of any of the above items if reasonably requested.

3. Our Commitment to You

We will:

  • Take all reasonable steps to run tours as described.
  • Comply with relevant laws and requirements from government authorities, land managers, and National Park operators.

4. Your Responsibilities

You agree to:

  • Follow all instructions given by our staff.
  • Behave respectfully toward other travellers and staff, and avoid conduct that may cause offence, distress, or harm.
  • Follow all safety procedures, rules, and site-specific requirements.
  • Take reasonable steps to protect your own safety.
  • Notify us immediately if any of your warranties (Section 2) become inaccurate.
  • Take responsibility for all costs relating to towing, recovery, repair, or maintenance of your own vehicle, including consequential losses.
  • Cover costs to repair or replace any equipment you use or provide that is damaged during the tour.
  • Pay any fines or penalties incurred by your actions.
  • Understand that tours may be cancelled if minimum numbers are not met.
  • Accept that we may remove you from the tour if you breach these Terms or if your removal is reasonably necessary for safety reasons.
  • Indemnify us for any loss we suffer due to your failure to provide accurate information or your breach of these Terms.

5. Bookings & Payments

  • A booking is made by providing written instructions and paying for the chosen trip.
  • We accept Visa, MasterCard, American Express, EFTPOS, and direct deposit. Credit card payments may incur a processing fee.
  • A booking is confirmed once we issue written confirmation.

6. Cancellations

If you cancel:

Tag-a-Long Tours, Short Getaways & Small Group Bus Tours:

  • Cancellations made 31 days or more before departure:
    Refund of monies paid, less non-refundable supplier deposits and reasonable administrative costs.
  • Cancellations made 30 days or less before departure:
    No refund is provided.
  • Change of mind:
    Trips / Tours will not be refunded for change of mind.

Day / Sightseeing Tours:

  • Cancellations made 24 hours or more before departure:
    Refund of monies paid, less non-refundable supplier deposits and reasonable administrative costs.
  • Cancellations made within 24 hours or less before departure:
    No refund is provided.

Discretionary Credit or Refund:

We may, at our discretion, offer a partial refund or travel credit for use on another tour departing within 12 months of your original date.


7. Limitation of Liability

To the maximum extent permitted by law:

  • We exclude liability for all loss, damage, cost, or claims of any kind, including consequential loss.
  • We are not responsible for the acts or omissions of third-party suppliers.
  • We are not responsible for injury, loss, or damage arising from your own actions during or after the tour.
  • We are not liable for losses caused by circumstances outside our control, including itinerary changes, weather events, natural disasters, transport delays, pandemics, border closures, government actions, or acts of war or terrorism.

8. General Conditions

  • These Terms may only be amended in writing and signed by both parties.
  • This agreement is governed by the laws of Queensland, and both parties submit to the jurisdiction of QLD courts.
  • Both parties must attempt to resolve disputes in good faith before commencing formal proceedings.
  • Unless you advise us otherwise in writing, you grant us permission to use photos or images of you taken during the tour for promotional or marketing purposes.
  • Where indicated, the children’s discount applies to children ages 4-14 years inclusive.
  • For Kuranda tours, children under the age of 4 travel for free.
  • For Cape Tribulation tours, children under the age of 4 are not permitted to travel.
  • Children under 16 years are not permitted to travel unless accompanied by an adult.
  • Family packages, where indicated, are for 2 Adults & 2 Children.
  • Please note that tours do not operate Christmas day.
  • Destinations such as Kuranda, Cape Tribulation, or Mossman Gorge are accessible to wheelchair users.
  • Certain tours may require additional aid, and our reservation team is ready to assist in exploring the available options.

Acceptance

By submitting a booking form, paying for a tour, or participating in the tour, you confirm that you have read, understood, and agree to these Terms & Conditions.
